CarAccidentLawyers.wiki, a sourced guide to car crashes, injuries, insurance and claims, has published a reference entry titled “Contingency fees and case costs in crash claims.” The entry, added to the site’s reference section on October 30, 2026, explains how a lawyer’s fee and the expenses of a case interact in car and truck crash claims under the Georgia Rules of Professional Conduct.
The entry takes up a cost question raised in recent coverage, including an On Pattison article on how much a tractor trailer crash lawyer typically costs. Rather than survey fee percentages, it explains the rules that shape any written fee agreement.
Under Georgia’s Rule 1.5, a contingency fee is permitted except where the rule or other law prohibits one, as the rule does for criminal defense and certain domestic relations matters, and the agreement must be in writing. The entry shows why the order of deductions matters. In an illustration using a one-third fee, deducting expenses after the fee makes the fee one third of the gross amount, while deducting expenses first makes it one third of what remains, so the client receives more by one third of the expenses.
Advanced costs are governed by Rule 1.8(e), which bars a lawyer from giving a client financial assistance in connection with pending or contemplated litigation, with two exceptions. A lawyer may advance court costs and litigation expenses, with repayment that may be contingent on the outcome, and a lawyer representing a client who cannot pay those costs may pay them on the client’s behalf. Whether advanced costs must be repaid if a truck accident claim produces no recovery is therefore a term to find in the agreement.
The entry gives examples of costs that come from outside the law firm. A federal civil action begins with a complaint and the filing fee required by statute, which a court can waive for a party unable to pay. Depositions involve a court reporter who prepares a word-for-word transcript. Georgia’s health-records statute lets a provider charge for search, retrieval, certification, copying and mailing of a patient’s records, within limits that may be adjusted each year for medical inflation.
“A percentage on its own does not show what a client will receive,” a spokesperson for CarAccidentLawyers.wiki said. “Georgia’s rule requires a contingency agreement to state the percentage or percentages that apply in the event of settlement, trial or appeal, and the litigation and other expenses to be deducted from the recovery. Read together, those written terms set how a recovery is divided.”
At the end of a contingent fee matter, whether it closes after an insurance settlement negotiation or a trial, Rule 1.5 requires a written statement of the outcome. If there is a recovery, the statement must show the amount paid to the client, how it was determined and the attorney fee. A fee divided between firms requires, among other conditions, that the client be told each lawyer’s share and not object to the participation of all the lawyers, and the total fee must be reasonable.
The rule’s reasonableness factors include the time and labor required, the difficulty of the questions, the fee customarily charged locally, the results obtained and whether the fee is fixed or contingent. For disagreements, the State Bar of Georgia runs a Fee Arbitration Program for disputes between lawyers and clients, and an agreement to arbitrate fee disputes requires the client’s informed consent in a signed writing, in a separate paragraph that both client and lawyer initial.
The entry also reports one firm’s published terms as an example and notes that an offer of a free case evaluation concerns the first conversation with a firm, while the written agreement governs the fee and the expenses of the representation. Like the rest of the publication, it is general information rather than legal advice about any agreement.
The release and its later syndicated copies are gathered on a companion page for this truck crash lawyer reference announcement.
